The agreement that governs access to and use of the GlobiGuard platform.

By accessing globiguard.com, using the GlobiGuard demo sandbox, joining our waitlist, or entering into any subscription, pilot, or design-partner agreement, you agree to be bound by these Terms of Service ("Terms"). If you are acting on behalf of a company, you represent that you have the authority to bind that entity.
GlobiGuard is an AI governance platform operated by Globi Explore, Inc. (Georgia, United States). It provides a control layer for AI-assisted workflows: intercepting data before it reaches AI models, applying configurable enforcement policies, routing decisions to human reviewers, and generating audit-supporting compliance records.
GlobiGuard is a technology tool — not a compliance programme, legal service, or regulated professional adviser. Customers are solely responsible for ensuring their AI deployments comply with all applicable laws.
GlobiGuard provides technology controls aligned with industry frameworks including GDPR, HIPAA, GLBA, CCPA, SOC 2, ISO 27001, ISO 42001, and the EU AI Act. GlobiGuard is NOT a substitute for a comprehensive compliance program, independent legal counsel, or third-party audit. Customers remain solely responsible for regulatory compliance.
GlobiGuard's AI detection systems (PII detection, policy enforcement) are designed to assist with compliance but may not catch every instance of sensitive data. Detection accuracy depends on configuration, data format, and deployment environment. Customers should implement additional safeguards appropriate to their risk profile and regulatory obligations.
These tier descriptions are high-level commercial summaries only. Exact active entitlements, deployment rights, and any runtime governance limits are governed by the applicable pilot terms, order form, and current workspace billing configuration.
Current pricing, pilot availability, annual billing discounts, deployment options, and order-form-specific commercial terms are published on the Pricing page and may be supplemented by an order form or enterprise agreement.
Design partners receive platform access in exchange for feedback and integration collaboration. Early-access terms are documented in a separate MOU or pilot agreement, which supplements these Terms.
API keys must be kept confidential. You are responsible for all activity under your keys. Rotate compromised keys immediately and notify [email protected].
You agree to provide accurate information, keep credentials confidential, and notify us immediately of any suspected unauthorised access. GlobiGuard may suspend or terminate accounts that violate these Terms or pose a security risk.
You must not use GlobiGuard to: process data without lawful authority; circumvent or falsify enforcement controls or audit logs; conduct security testing without written consent; misrepresent GlobiGuard's role to regulators or auditors; process real data in the Sandbox; or resell access without a written commercial agreement. All rights in the GlobiGuard platform — runtime services, policy logic, dashboard, APIs, SDKs, and documentation — remain with Globi Explore, Inc. You retain ownership of your Customer Data and configured policies. We receive a limited licence to process Customer Data solely to provide the service.
Feedback you provide may be used by GlobiGuard without obligation to you.
Each party agrees to keep the other's Confidential Information strictly confidential, use it only for the purposes of the commercial relationship, and disclose it only to personnel with a need to know. These obligations survive for 3 years after disclosure, or indefinitely for trade secrets.
GlobiGuard processes Customer Data as a data processor on your behalf. You are the data controller. Our obligations as processor are set out in the Data Processing Agreement, which is incorporated by reference for all paid subscribers. Customers who require a signed DPA may request one at [email protected].
THE GlobiGuard PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLOBI EXPLORE, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL DETECT OR BLOCK EVERY INSTANCE OF PII OR POLICY-VIOLATING CONTENT, THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ITS COMPLIANCE OUTPUTS CONSTITUTE LEGAL OR REGULATORY ADVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, GLOBI EXPLORE, INC. SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR REGULATORY FINES OR PENALTIES BROUGHT AGAINST CUSTOMER. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) FEES PAID IN THE TWELVE MONTHS PRECEDING THE INCIDENT, OR (B) US $1,000. NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD OR FOR LIABILITY THAT CANNOT BE LIMITED BY LAW.
You agree to indemnify and hold harmless Globi Explore, Inc. from claims arising from: your violation of these Terms or applicable law; your failure to obtain lawful authority to process Customer Data; regulatory actions resulting from your non-compliant use; misrepresentations to regulators or auditors; or claims by your end-clients arising from your AI workflows.
You may terminate your subscription at any time; termination takes effect at the end of the billing period. Prepaid fees are non-refundable unless agreed in writing. GlobiGuard may terminate immediately for material breach, security risk, or non-payment (after a 10-day grace period). On termination, all licences cease and Customer Data return, export, deletion, or handoff is handled under the DPA, the applicable order form, and the deployment model. Sections 6, 7, 9, 10, 11, and 14 survive.
Material changes will be notified by updating the "Last Updated" date and, for active subscribers, by email at least 14 days before they take effect.
These Terms are governed by the laws of Georgia, United States. Disputes shall be resolved by binding arbitration under AAA Commercial Arbitration Rules. Class actions are waived. Either party may seek injunctive relief in any court of competent jurisdiction.
These Terms, together with the DPA, any order form, and any MOU, constitute the entire agreement. If any provision is unenforceable it will be modified to the minimum extent necessary. You may not assign your rights without our written consent.
